Terms and Conditions

Please note that it is essential to read and understand the following terms and conditions, it is a contract between you and Original Trails. When you make your booking and pay your deposit you acknowledge that you have read and agreed to the terms and conditions. Also, please ensure you have read and understood the itinerary and the style of travel that you will be partaking in.

These are the terms and conditions governing the relationship between Original Trails Inc, hereinafter referred to as “OT” or “The company” and you, hereinafter referred to as “The client”.

Bookings shall be confirmed in writing via email. Bookings shall be considered confirmed only when the booking is accompanied by a deposit valued at 50% of the tour price per person, whose receipt has been acknowledged by OT. If the booking is made 60 days or less prior to departure, full payment is required. Original Trails custom made adventures may require a higher deposit at time of booking. Payments will be in US dollars only.

The remaining balance must be paid 60 days prior to the trip departure date. Confirmation will be sent in writing by OT to the client by email along with an invoice. If payment is not received within 60 days of tour commencement and unless arrangements have been made prior with authorized OT management, the booking will be considered cancelled and cancellation conditions will apply.

Any cancellation of a reservation must be in writing, by e-mail and shall only be effective upon its receipt and acknowledgment. The following fees will be applied for cancellations:
  • More than 60 days prior to trip commencement: 50% of tour price.
  • 59 to 30 days prior to trip commencement: 75% of tour price.
  • No show to 30 days prior to trip commencement: 100% of the total tour price.
OT reserves the right to cancel any trip before it is guaranteed to run, but will not cancel a trip no less than 30 days prior to the departure except for the following reasons:
  • “Force majuere”
  • Unforeseen circumstances beyond the company’s control.
  • The minimum number for a tour to run has not been reached on set departures

In the case of “Force Majure” or unforeseen circumstances beyond the companies control, OT will inform the client as soon as possible of a cancellation. If the minimum number of people to run the tour has not been reached, clients will be notified no later than eight weeks prior to the trip departure date. Clients holding a fully paid booking may choose between an alternative trip or a full refund. The company is not responsible for any incidental expenses that the client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or loss of enjoyment, etc. If the alternative trip chosen is of a lower value than that originally booked then you are entitled to a refund of the price difference. If the alternative tour chosen is of a higher value then the client will pay the difference in price.

Please note that refunds will not be given for the following:
  • Lost travel time or substitution of facilities.
  • Presence of circumstances beyond company’s control which requires alternative arrangements be made to ensure the safety and enjoyment of your tour.
  • Unused services for any accommodation, activity or tour segment without prior notice.
  • Premature contract termination.
The client appreciates and acknowledges that the nature of adventure travel requires considerable flexibility and should allow for alternatives. It is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events, which may include sickness or mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, climate and other unpredictable circumstances.
OT and its owners, directors, management staff and employees including sub-contracted or local operators and their employees, shall not be held responsible for any injury or death to persons on tour, nor for loss or damage to personal property, however they may be caused. It is the clients sole responsibility to obtain appropriate medical advice as to medication, immunization, and whether or not you are fit enough to undertake the trip, prior to departure. OT shall not be liable for illness, injury or death sustained whilst visiting the properties owned and managed by OT.
The client acknowledges that she/he will be visiting places where the political, cultural and attributes present certain risks, dangers and physical challenges greater than those present in our daily lives. By booking geographical travel with OT, the client acknowledges that she/he has considered the potential risks, dangers and challenges, and expressly assumes the risks attendant to such travel conditions. The client is solely responsible for acquainting her/himself with the customs, weather conditions, physical challenges and laws in effect at each stop along the itinerary, and is encouraged to locate or make contact prior to embarkation with his/her local embassy or consulate in each destination.
“Force Majeure “ means, in relation to OT, any circumstances beyond the control of OT (including and without limitation to, acts of God, explosions, floods, tempests, fires, accidents, war or threat of war, sabotage, terrorist attack, insurrection, civil disturbance or requisition, sickness, quarantine, government intervention, weather conditions or other outwards occurrences) If OT is affected by force majeure it shall notify the client of the nature and extent thereof.

OT shall not be deemed to be in breach of these items and conditions or otherwise be liable to the client, by reason of delay in performance or by non-performance of any of its obligations hereunder to the extent that any such delay or non-performance is due to any force majeure.

If OT is affected by force majeure it shall be entitled to, and may at its sole and absolute discretion, vary or cancel any reservations or cancel any reservation or arrangement in relation to the visits. Payment of any refund by the company to the client as result of the non-performance of any company shall use its reasonable endeavors to reimburse the client where possible. However, OT shall be entitled to deduct from any refund recoverable to the reasonable actual and potential costs to OT of the force majeure.
It is mandatory that all clients obtain travel insurance while traveling with OT and this insurance must cover personal injury, medical expenses,repatriation expenses, and evacuation expenses. The client must be able to provide proof of insurance purchase and adequate coverage as per the required amounts above if requested by the group leader or an OT representative. It is strongly recommended the coverage be extended to include cancellation, curtailment, loss of belongings and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the client. OT cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by OT such as hotels,vehicles, or any other mode of transportation.
If the client has any cause of complaints while travelling, you must immediately bring it to the attention of an OT representative or agent who will attempt to resolve the situation. If no resolution is found, the client must write a letter via email to OT outlining the complaint/dispute no more than 15 days after the tour has ended.
The payment of the deposit or any other partial payment for a reservation constitutes consent to all provisions of the Terms and Conditions. The terms under which you agree to make the reservation cannot be changed or amended unless this is done in writing and signed by an authorized staff of OT. All decisions and matters subject to the company’s discretion shall be by authorized officer of the company.
